Elder Abuse

California Elder Abuse Law

Our elder abuse attorneys represent elders or dependent adults who have experienced either physical or financial abuse from insufficient staffing and resources at nursing homes, assisted living facilities, or hospitals.

What Constitutes Elder Abuse?

Elder abuse is defined by neglect, abandonment, isolation, abduction, deprivation, theft, fraud, or other treatment that causes harm or mental suffering. In these cases, trust is placed in the hands of caregivers or hospital staff and that trust is abused or exploited. Elder abuse can be both physical and financial in nature.

Physical abuse refers to any of the following:

  • Starvation
  • Dehydration
  • Over-medication
  • Pressure sores
  • Neglect
  • Falls

Financial elder abuse encompasses the following:

  • Overcharging or double billing for medical care
  • Recommending false remedies for medical conditions
  • Medicaid fraud
  • Getting kickbacks for referrals or drug prescriptions

Causes of Elder Abuse

In numerous situations, elder abuse occurs because nursing homes and other facilities do not have sufficient financial resources to efficiently care for its residents. Not enough money is spent on resident care to accommodate the residents, which sometimes results in unqualified or not enough staff members. Employees are not trained, call lights are ignored, administration fails to maintain an adequate staff to resident ratio, and, therefore, patients do not receive necessary care.
